Welcome to Breakrr ("we," "our," or "us"). These Terms of Use ("Terms") govern your use of the Breakrr mobile application and related services (collectively, the "Service") operated by Getting Comfy LLC.

By downloading, installing, or using the Breakrr app, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

These Terms constitute a legally binding agreement between you and Getting Comfy LLC. Please read them carefully.

Eligibility and Account Requirements

Age Requirements

• You must be at least 13 years old to use Breakrr
• Users under 18 must have parental/guardian consent
• We may request age verification at any time

Account Registration

• You must provide accurate and complete information
• You are responsible for maintaining account security
• One account per person - no multiple accounts
• You must notify us of unauthorized account access

Device Requirements

• Compatible iOS device with Screen Time capabilities
• iOS 14.0 or later required for full functionality
• Screen Time permissions required for app blocking features

Acceptable Use

You MAY:

• Use Breakrr for personal digital wellness
• Share your progress and achievements
• Provide feedback and feature suggestions
• Contact support for technical issues

You MAY NOT:

• Reverse engineer or modify the app
• Use the Service for illegal activities
• Attempt to bypass Screen Time restrictions
• Share your account credentials
• Upload malicious content or code
• Violate others' privacy or rights

Screen Time Integration

Permission Requirements

Breakrr requires Screen Time permissions to provide app blocking and usage monitoring features.

Your Responsibilities

You are responsible for granting appropriate permissions and configuring Screen Time settings.

Limitations

We cannot guarantee blocking effectiveness if Screen Time permissions are revoked or device restrictions are modified.

No Circumvention

Users agree not to attempt to bypass or circumvent Screen Time restrictions implemented through Breakrr.

Subscription and Billing

Subscription Plans

• Free tier with basic features available
• Premium subscriptions available via App Store
• Billing managed through your Apple ID account
• Prices may vary by region and are subject to change

Billing and Renewals

• Subscriptions auto-renew unless cancelled
• Cancel anytime through App Store settings
• Refunds subject to App Store policies
• No partial refunds for unused subscription periods

Free Trial Terms

• Free trials may be offered for premium features
• Trial automatically converts to paid subscription
• Cancel before trial ends to avoid charges
• One free trial per user account

Service Limitations and Disclaimers

Service Availability

• Service provided "as is" without warranties
• We do not guarantee uninterrupted service
• Maintenance may temporarily affect availability
• Features may be modified or discontinued

Medical Disclaimer

Breakrr is not a medical device or treatment:

• Not intended to diagnose, treat, or cure any condition
• Consult healthcare professionals for medical advice
• Digital wellness features are for general productivity
• We make no health-related claims or guarantees

Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect or consequential damages
• Our total liability is limited to subscription fees paid
• We are not responsible for third-party service failures
• Users assume risk of using digital wellness tools

Intellectual Property Rights

Our Rights

• Breakrr app and content are our property
• Protected by copyright and trademark laws
• You receive limited license to use the app
• License terminates when Terms end

Your Rights

• You retain ownership of your personal data
• You grant us license to process your data
• Feedback becomes our property
• You may export your data upon request

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy.

By using Breakrr, you consent to the data practices described in our Privacy Policy.

Termination

Termination by You

• You may stop using the Service anytime
• Cancel subscriptions through App Store
• Request account deletion via email
• Uninstall the app to remove local data

Termination by Us

• We may suspend accounts for Terms violations
• Permanent termination for repeated violations
• Service may be discontinued with notice
• No refunds for terminated accounts due to violations

Effect of Termination

• Your right to use the Service ends immediately
• Data deletion occurs per Privacy Policy
• Survival clauses remain in effect
• Outstanding payments remain due

Legal Terms

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Dispute Resolution

• Informal resolution attempted first
• Binding arbitration for unresolved disputes
• Class action waiver applies
• Delaware courts have jurisdiction

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through:

• Email notifications to registered users
• Updates to this page with revised date

Continued use of the Service after changes constitutes acceptance of the modified Terms.
